  1. Targeted Advertising. Like many companies, Rubber-Cal processes personal information for targeted advertising. You can also opt-out of targeted advertising by (a) selecting Do Not Sell or Share My Personal Information and submitting an opt-out request to us, and by (b) selecting Cookie Settings on Rubber-Cal’s website and disabling cookies.
  2. Privacy Rights. Under applicable law, you may have the following rights, in each case under the conditions and to the extent set out in applicable law:
    • Right of Access: A right to confirm whether Rubber-Cal is processing personal information about you, and to request to access such personal information (including, if applicable, in a portable and readily usable format).
    • Right of Correction: A right to correct inaccuracies in certain personal information Rubber-Cal may hold about you; and
    • Right of Deletion: A right to request that Rubber-Cal delete personal information concerning you. Please note that if you have requested a service that requires the use of your personal information, we may not be able to provide that service if you choose to delete your personal information.

If any of the above rights are available to you under applicable law, you can submit a request to exercise your rights by visiting the Rubber-Cal’s Privacy Policy Center.
If your rights request is denied, applicable law may give you a right to lodge an appeal with us. The response to your rights request will inform you of any appeal rights you may have, and tell you how you can exercise them.

CALIFORNIA

This notice to California residents is provided under California law. It provides our “Notice at Collection,” provides certain mandated disclosures about our treatment of California residents’ information, both online and offline, explains your privacy rights, and provides our “Notice of Financial Incentives.”

We may collect the following categories of personal information (as defined in the California Consumer Privacy Act (CCPA) and the California Customer Records statute), including sensitive personal information (as defined in the CCPA):

  • Identifiers, such as name, email address, username and password, postal address, telephone number, signature, government-issued identifier, license plate number, IP address, and other similar identifiers.
  • Characteristics of protected classifications and demographic information, such as gender, age, race, disability status, sexual orientation, gender identity, military/veteran status, marital status, national origin, and medical information.
  • Commercial information, including information about your interests and consuming history or tendencies, such as products or services considered; transaction information when you request information, contact Customer Service or purchase, return, request or exchange a product or service, including payment card information or other financial information; information provided in response to surveys or other research conducted on our behalf; and information you provide in public forums.
  • Internet or other electronic network activity information, including information regarding your interactions with us online and information we obtain from third parties about use of our applications on third-party platforms or devices.
  • Geolocation data, including precise or approximate location information provided by a mobile device or other device or product interacting with or detected by our sites, applications, or physical properties, where we are permitted by law to process this information.
  • Audio, electronic, visual, or similar information, including telephone call recordings, other voice recordings, and still or video images captured by cameras or readers on or around our physical properties.

What is “personal information”? For the purposes of this California Privacy Policy, “personal information” is defined as information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular California consumer or California household. Personal information does not include:

  • Publicly available information from government records.
  • De-identified or aggregated information.
  • Other regulated information that is excluded from the CCPA’s scope, such as: medical information governed by the California Confidentiality of Medical Information Act (CMIA); protected health information collected by a covered entity or business associated governed by the Health Insurance Portability and Accountability Act of 1996 (HIPAA); clinical trial data subject to the Federal Policy for the Protection of Human Subjects; personal information covered by certain sector-specific privacy laws, including the Fair Credit Reporting Act (FRCA), the Gramm-Leach-Bliley Act (GLBA) or California Financial Information Privacy Act (FIPA), and the Driver’s Privacy Protection Act of 1994.

What are “California consumers”? A “California consumer” is a natural person who resides in California. For the purposes of this California Privacy Policy, a California consumer does not include persons to the extent they are (i) acting as an employee, owner, director, officer or contractor of a company, partnership, sole proprietorship, nonprofit or government agency that is doing business with Rubber-Cal or (ii) acting as a job applicant to, an employee of, owner of, director of, officer of, medical staff member of, or contractor of Rubber-Cal.

California-Use of Personal information

We collect this information so that we can best serve you, including to fulfill your requests and to share offers or information that we think you may be interested in. As further described in the “How Collected Information is Used” section in our Privacy Policy, we generally collect and use the above-listed categories of personal information to provide and manage our sites, applications, products, and services, and for other business or commercial purposes, such as advertising, marketing, and to improve our products and services.

California-Disclosure of Personal information

Certain data collection on our sites and applications by third parties for purposes of interest-based advertising and social media tools may be a “sale” or “sharing” under California privacy law. As defined by California law, we “sold” or “shared” certain data elements within the following categories of personal information: identifiers, demographic information, commercial information, Internet or other electronic network activity information, approximate geolocation, and inferences drawn from the above.

We retain each category of personal information that we collect for as long as necessary to fulfill the purposes described in our Privacy Policy, including to satisfy legal or reporting requirements. What this means in practice will vary for different types of information, but the criteria assessed in the data retention analysis take into account ongoing business or legal needs for the information, for example in relation to tax, health and safety, and potential or actual disputes or investigations.

We collected the following categories of personal information in the last 12 months: identifiers, characteristics of protected classifications and demographic information, commercial information, Internet or other electronic network activity information, geolocation data, audio, electronic, visual or similar information, and inferences drawn from the above.
The sources of personal information from whom we collected are: directly from our customers, third-party sites or platforms that you link with your registration account, analytics tools, social networks, advertising networks, and third-party services that update or supplement information we hold about you.

The business or commercial purposes of collecting personal information are as summarized in our Privacy Policy under “How Collected Information is Used.”
We disclosed certain data elements within the following categories of personal information for a business purpose in the last 12 months: identifiers, characteristics of protected classifications and demographic information, commercial information, Internet or other electronic network activity information, geolocation data, audio, electronic, visual or similar information, and inferences drawn from the above. We disclosed each category to business partners, service providers, government entities, and other third parties as described in the “How Collected Information is Shared” section of the Privacy Policy.

As defined by applicable law, we “sold” or “shared” certain data elements within the following categories of personal information in the last 12 months: identifiers, demographic information, commercial information, Internet or other electronic network activity information, approximate geolocation, and inferences drawn from the above. We “sold” or “shared” each category to or with entities who provide advertising, marketing, or audience measurement; other online third-party branded tools or functionality (such as maps or video players); and social networks.
The business or commercial purposes of “selling” or “sharing” personal information is to assist us with advertising, marketing, audience measurement, and other functionality on our digital properties.

We do not “sell” or “share” the personal information of known minors under 16 years of age.
We do not use or disclose sensitive personal information for purposes other than those specified in Section 7027(m) of the CCPA regulations.

California-privacy rights

CCPA RIGHTS FOR CALIFORNIA CONSUMERS

The CCPA provides California consumers with certain rights regarding their personal information. This Section III explains those rights. If you are a California consumer and would like to exercise any of those rights, please see Section III.E (How to Submit a Request) below for more information on how to submit a request.

RIGHT TO KNOW ABOUT AND ACCESS YOUR PERSONAL INFORMATION

If you are a California consumer, you may have the right to request that Rubber-Cal provide you with information regarding what personal information about you we have collected, used, disclosed, or sold in the preceding twelve (12) months. Once we receive your request and verify your identity, we will disclose to you the following:

  • The categories of personal information we have collected about you in the preceding twelve (12) months.
  • The categories of sources from which we collected your personal information in the preceding twelve (12) months.
  • The business or commercial purposes for collecting your personal information in the preceding twelve (12) months.
  • The categories of third parties with whom we shared your personal information in the preceding twelve (12) months.
  • The specific pieces of personal information we collected about you in the preceding twelve (12) months.

RIGHT TO DELETE YOUR PERSONAL INFORMATION
If you are a California consumer, you may have the right to request that Rubber-Cal delete certain personal information that we have collected from you. However, this right to deletion does not apply to any of your personal information that is subject to an exception under the CCPA (as described below). Once we receive your request and verify your identity, we will delete (and direct our service providers to delete) your personal information in our records that is not subject to any of the CCPA exceptions. Specifically, we may deny your deletion request if your personal information is required for any of the following reasons, which we will identify in our response to you if we deny your request:

  • Complete the transaction for which we collected the personal information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform our contract with you to be able to fulfill the terms of a written warranty or product recall conducted in accordance with federal law.
  • Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities.
  • Debug products to identify and repair errors that impair existing intended functionality.
  • Exercise free speech, ensure the right of another consumer to exercise their free speech rights, or exercise another right provided for by law.
  • Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 seq.).
  • Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information’s deletion may likely render impossible or seriously impair the research’s achievement, if you previously provided informed consent.
  • Enable solely internal uses that are reasonably aligned with your expectations based on your relationship with us.
  • Comply with a legal obligation.
  • Make other internal and lawful uses of that information that are compatible with the context in which you provided it.

RIGHT TO OPT-OUT OF THE SALE OF YOUR PERSONAL INFORMATION

If you are a California consumer, you may have the right to request that Rubber-Cal stop selling certain or all your personal information. Once we receive your request and verify your identity, we will process your request as soon as feasibly possible and will also provide notification of your request to any third parties to whom we sold your personal information in the ninety (90) days prior to your request. You may also use an authorized agent to submit a request to opt-out on your behalf, as long as you provide the authorized agent with written permission to do so, and the agent provides such proof to us when they submit your request. If you opt-out and subsequently enter into any transactions where a sale of your personal information is required as a condition of completing the transaction, we will provide you with instructions on how you may opt back in. In addition, your opt-out will not affect any situations where you direct us to transfer your personal information to a third party.

RIGHT TO NON-DISCRIMINATION
Rubber-Cal will not discriminate against any California consumer who exercises any rights of the CPPA described above. Specifically, we will not deny you goods or services; charge you different prices or rates, including through granting discounts or other benefits, or imposing penalties; provide you with a different level of service or quality of goods or services; or suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.

HOW TO SUBMIT A REQUEST

SUBMITTING A REQUEST THROUGH YOUR AUTHORIZED AGENT

If you are a California consumer, you may have the option to designate an authorized agent to submit a request on your behalf, so long the authorized agent has your written permission to do so and you have taken steps to verify your identity directly with us. If you would like to designate an agent, your agent must register as such with the California Secretary of State and submit a copy of this registration along with your consumer request to us. We may need to contact you directly to verify the request.

HOW WE VERIFY YOUR REQUEST

We cannot fulfill your request or provide you with your personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you. Making a verifiable consumer request does not require you to create an account with us.
To verify your identity, we will ask that you provide the following personal information when you submit your request:

You may need to provide additional information as part of your responses to our identity verification questions. We will only use this information to confirm your identity which may include the use of a third-party identity verification service. In the event we use a third-party identity verification service, our third-party identification verification tool will ask you certain identity verification questions and match those answers with what it has in its database. Depending on your type of request or the information requested by you, we may require additional information in order to verify your identity and fulfill your request.
If we cannot successfully verify your identity, we will inform you of that fact.
We will respond to your request within forty-five (45) days. However, in certain circumstances, we may require additional time to process your request, as permitted by the CCPA or other applicable law. We will advise you within forty-five (45) days after receiving your request if such an extension is necessary and why it is needed. Any disclosures we provide will only cover the 12-month period preceding our receipt of your verifiable consumer request.
If we cannot fulfill your request, our response to you will also explain the reason why we cannot fulfill your request.
We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.
You may only make a verifiable consumer request to know about or access your personal information twice within a 12-month period.

Right to Know
You have the right to request that we disclose to you the categories of personal information we have collected about you, as well as the sources of such personal information, the purposes, and the categories of third parties with whom such personal information is shared.

Right to Access

You have the right to request, up to two times each year, access to categories and specific pieces of personal information about you that we collect, use, disclose, sell, and share.

Right to Delete

You have the right to request that we delete personal information that we collect from you, subject to applicable legal exceptions.

Right to Correct

You have the right to request that we correct inaccurate personal information that we maintain about you, subject to applicable legal exceptions.

Right to opt Out of Sale or Sharing of Personal Information

You have the right to “opt out” of the “sale” or “sharing” of your “personal information” to or with “third parties” (as those terms are defined by applicable law).

Removal of Content

If you are a California resident under the age of 18, and a registered user of any site where this policy is posted, California Business and Professions Code Section 22581 permits you to request and obtain removal of content or information you have publicly posted.

Shine the Light

California Civil Code Section 1798.83 permits you to request information regarding the disclosure of your personal information by Rubber-Cal to third parties for the third parties’ direct marketing purposes. Rubber-Cal does not share customers’ personal information with other member companies or others outside Rubber-Cal for those parties’ direct marketing use unless a customer elects that we do so.

Right Not to Receive Discriminatory Treatment
You have the right not to receive discriminatory treatment for the exercise of your privacy rights. If you choose to exercise any of these rights, you will not receive different prices or quality of services unless permitted by applicable law, including if those differences are reasonably related to your information. For example, if you exercise your right to opt out of “sale” or “sharing” of your ”personal information,” the ads you view may not be tailored to your interests.

Notice Of Financial Incentives

We may offer various financial incentives and benefits (such as free shipping, discounts, and other special offers) to customers who interact with us in our stores or via our sites and provide certain personal information to receive the stated incentive or benefit. Generally, for any financial incentive we offer, we do not assign monetary or other value to personal information; however, the value of the personal information provided by you is reasonably related to the estimated value of the relevant financial incentive for which the information was collected. We reserve the right to withdraw or modify the financial incentives we offer at any time. The terms of the incentive will be presented to you at the time you sign up.
